Laws Regarding Grandparentage Testing in NYC

New York State Laws mandate that the biological parents give consent on behalf of the child to administer a DNA test. Specifically, the law refers to the individuals named on the child’s birth certificate. As a result, in addition to the grandparents, a legal parent of the child must provide consent to administer grandparentage testing in NYC.

 

Who is required for Grandparentage Testing?

Ultimately, the most preferable testing scenario out of the four options is the first choice. By testing the child, the mother, and two grandparents, we achieve a much more accurate result. Each person we remove from the equation, let it be a grandparent or the mother, decreases the accuracy of a grandparentage test. Hence, to provide the most accurate results, it’s best to include all four individuals.

+ What if the alleged father is not available for testing?

When it is not possible to test an alleged father, paternity can be established indirectly (i.e. grandparents, siblings, aunts, uncles, etc).

+ How is a DNA collection performed?

A DNA collection is quick and painless. A sterile swab is rubbed on the inside of your mouth for 20-30 seconds to collect cheek cells.

+ How accurate is the test?

DNA Testing is extremely accurate. The laboratory meets or exceeds all standards established by the AABB. Results for a standard legal paternity test is guaranteed at least 99.99% probability of paternity for inclusions or 100% certainty of exclusion.
